Indictment in Domestic Violence Case

DELHI – District Attorney Shawn Smith announced today that Scott D. Googins, 28, of Delhi, New York, was indicted by the Delaware County Grand Jury on April 11, 2024, and a three-count indictment was filed. 

Count One of the indictment charged the defendant with Strangulation in the Second Degree, a Class D Felony.  It is alleged that the defendant, on or about November 23, 2023, choked the female victim with both of his hands until she lost consciousness. 

Count Two of the indictment charged the defendant with Assault in the Third Degree, a Class A Misdemeanor.  That count alleges that the defendant intentionally caused physical injury to the same female victim. 

Count Three of the indictment charged the defendant with Criminal Mischief in the Fourth Degree, a Class A Misdemeanor.  That count alleges that the defendant prevented the victim from calling 911 during the domestic assault. 

The defendant is currently released from custody after posting $3,000 cash bail.  If convicted of Strangulation in the Second Degree, the defendant faces up to 7 years in state prison. 

First Assistant District Attorney Schuyler Konior Kinneman presented the case to the Grand Jury. 

District Attorney Shawn Smith commended New York State Trooper Jamal Ahmed, State Police Investigator Mark Head, and Sheriff’s Deputy Lucas Elmore for their thorough investigation into this case.  

As are all persons accused of a crime, this defendant is presumed innocent unless proven guilty.
